ASACC Marketplace Terms & Conditions

As Seen At Comic Con (“ASACC”) is an online marketplace operated by Red Cape Solutions Ltd.

ASACC enables independent traders and sellers to offer products to customers through the marketplace.

By using ASACC you agree to these Terms & Conditions.

1. The ASACC marketplace

Products available through ASACC may be sold by independent third-party traders.

The identity of the relevant seller should be shown on the marketplace.

Unless a listing expressly states that Red Cape Solutions Ltd is the seller, the contract for the purchase of goods is between the buyer and the relevant trader.

ASACC provides the marketplace technology and facilitates transactions between buyers and sellers.

Nothing in these terms removes any statutory rights a consumer has under UK law.

2. Accounts

You must provide accurate information when creating or using an account.

You are responsible for maintaining the security of your login credentials and for activity undertaken through your account.

We may suspend or restrict accounts where reasonably necessary to protect users, investigate suspected fraud or misuse, comply with law, or enforce these terms.

3. Products and listings

Individual sellers are responsible for the accuracy of their listings, including descriptions, photographs, condition, authenticity, price, availability and delivery information.

Because ASACC specialises in collectibles, buyers should read condition descriptions carefully before purchasing.

Where an item is described as signed, authenticated, graded, limited, rare or otherwise possessing a particular provenance, the seller is responsible for ensuring that description is accurate and not misleading.

4. Orders and payment

Orders are subject to availability and acceptance.

Payment is taken using the payment methods available during checkout.

ASACC and its payment providers may undertake security and fraud checks.

Where an order cannot lawfully or reasonably be fulfilled, it may be cancelled and the appropriate payment refunded.

5. Prices

Prices are displayed in pounds sterling unless stated otherwise.

Delivery charges and other applicable charges will be shown before the buyer completes the purchase.

The seller is responsible for correctly determining any taxes applicable to their sales.

6. Delivery

The seller is responsible for dispatching purchased goods within the timescale stated on the listing or otherwise communicated to the buyer.

Sellers are responsible for suitable packaging and for using an appropriate delivery service.

Sellers must obtain and retain appropriate proof of postage or dispatch for orders and are responsible for selecting a postal or courier service suitable for the nature and value of the goods being sent.

Where appropriate cover is reasonably available, sellers must ensure that the delivery service selected provides compensation or insurance appropriate to the full value of the goods. Sellers should take the cost of suitable delivery, tracking, signature and any appropriate compensation or insurance cover into account when setting their shipping charges.

If an item is lost or damaged in transit, responsibility for pursuing any available claim with the postal or courier provider rests with the seller. This does not affect the buyer’s statutory rights.

Sellers should retain proof of dispatch, tracking information and relevant delivery documentation until the transaction has been satisfactorily completed and any applicable dispute or claim period has passed.

7. Returns, cancellations and refunds

Consumer rights vary depending on the item, seller and circumstances.

Nothing in these terms limits rights provided by applicable consumer law.

Our Returns and Refunds Policy explains how returns, cancellations, damaged items and refunds are handled through ASACC.

8. Problems with an order

Buyers should raise problems promptly through the contact/support facilities provided.

ASACC may communicate with the buyer and seller, review available evidence and assist in resolving marketplace disputes.

ASACC may issue or facilitate refunds where appropriate under applicable law, marketplace policy or payment-provider requirements.

9. Authenticity and counterfeit goods

ASACC does not permit sellers knowingly to list counterfeit, fraudulent or unlawfully reproduced goods.

We may remove listings, suspend sellers, request evidence of authenticity and cooperate with rights holders or authorities where appropriate.

ASACC cannot physically inspect every item offered by independent sellers and does not guarantee the authenticity of every third-party listing.

10. Intellectual property

Users must not upload or sell content or products in a manner that infringes another person’s intellectual-property rights.

Rights holders may contact ASACC regarding listings they believe infringe their rights.

11. Prohibited activity

Users must not use ASACC for unlawful, fraudulent, deceptive, abusive or harmful activity.

We may remove content, cancel transactions or restrict accounts where reasonably necessary to protect ASACC, its users or third parties.

12. Reviews and content

Reviews and other user-submitted content must reflect genuine experiences and must not be fraudulent, defamatory, abusive or deliberately misleading.

We may moderate or remove content that breaches these requirements.

13. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

ASACC is not responsible for losses caused solely by an independent seller’s acts or omissions except where ASACC has a legal responsibility for that loss.

14. Changes to ASACC

We may change, improve, suspend or discontinue parts of the marketplace.

Where a change materially affects existing contractual rights, it will not retrospectively remove rights already accrued.

15. Governing law

These terms are governed by the laws of England and Wales.

Consumers retain any mandatory rights relating to jurisdiction that apply to them.
