ASACC Privacy Policy

As Seen At Comic Con (“ASACC”) is operated by Red Cape Solutions Ltd (“we”, “us”, “our”).

ASACC operates an online marketplace connecting independent traders and sellers with customers looking for collectibles, trading cards, memorabilia, artwork, comics, toys and other convention-related products.

This Privacy Policy explains how we collect, use and protect personal information when you visit or use ASACC.

1. Who is responsible for your information?

For the purposes of UK data protection law, Red Cape Solutions Ltd is the data controller for personal information we process in operating ASACC.

2. Information we collect

Depending on how you use ASACC, we may collect:

  • your name;
  • billing and delivery addresses;
  • email address and telephone number;
  • account and login information;
  • order and transaction information;
  • communications with ASACC and sellers;
  • trader/store information;
  • information required to verify sellers;
  • information required for tax, accounting or regulatory purposes;
  • IP address, browser, device and security information;
  • cookie and website usage information;
  • marketing preferences;
  • reviews, listings, photographs and other content you submit.

We do not normally receive or store your full payment-card details. Payments and seller payment onboarding may be handled by specialist payment providers such as Stripe.

3. Why we use your information

We may process personal information to:

  • create and administer customer and trader accounts;
  • process and administer marketplace orders;
  • enable sellers to fulfil orders;
  • arrange and administer payments, commissions, refunds and withdrawals;
  • provide customer service;
  • investigate disputes, fraud, chargebacks and misuse;
  • communicate important information about accounts and orders;
  • operate and improve ASACC;
  • maintain the security of the marketplace;
  • comply with legal, tax, accounting and regulatory obligations;
  • verify sellers and, where required, report seller information to HMRC;
  • send marketing where you have consented or where otherwise permitted by law.

Our lawful bases may include performance of a contract, compliance with a legal obligation, our legitimate interests in operating and protecting the marketplace, and consent where required.

4. Marketplace orders

ASACC is a multi-seller marketplace.

When you purchase from a trader, relevant order information — such as your name, delivery address, contact details and items ordered — may be made available to that seller where necessary to fulfil the order and provide customer service.

Sellers must use customer information only for legitimate purposes connected with the transaction and must comply with applicable data protection law.

5. Payments and Stripe

ASACC uses third-party payment services to facilitate payments and seller payouts.

Payment providers may process identifying, financial, transactional and verification information under their own privacy terms.

Traders connecting a Stripe account provide their financial and verification information directly to Stripe. ASACC does not require traders to provide their online banking credentials to ASACC.

6. Seller verification and HMRC reporting

UK rules for digital platforms may require us to collect and verify information about sellers and, where applicable, report information about reportable sellers and their transactions to HM Revenue & Customs.

This may include identifying information, addresses, tax identification information and transaction/payment information.

Where we are legally required to collect, retain or report this information, we process it to comply with our legal obligations.

7. Who we share information with

Where necessary, information may be shared with:

  • sellers involved in your order;
  • payment processors and financial service providers;
  • website hosting and technology providers;
  • delivery and logistics providers where applicable;
  • email and communications providers;
  • professional advisers;
  • fraud prevention and security providers;
  • HMRC, regulators, law enforcement or other authorities where legally required.

We do not sell personal information to advertisers.

8. Marketing

Signing up for an ASACC account or entering a promotion does not automatically subscribe you to marketing.

Where consent is required, marketing consent will be requested separately.

You can unsubscribe from marketing communications at any time using the unsubscribe facility provided or by contacting us.

Transactional communications relating to orders, accounts, security or marketplace administration are not marketing and may still be sent where necessary.

9. Cookies

ASACC uses cookies and similar technologies required for functions including baskets, checkout, account login, security and website preferences.

We may also use analytics or marketing technologies where permitted and, where required, with your consent.

You can manage applicable cookie choices through the site’s cookie controls and/or your browser.

10. How long we keep information

We retain information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, accounting, tax, fraud-prevention and dispute-resolution requirements.

Some transactional and financial records may therefore be retained after an account is closed.

11. International processing

Some service providers may process information outside the UK.

Where personal information is transferred internationally, we take appropriate steps required by applicable UK data protection law to protect that information.

12. Your rights

Depending upon the circumstances, UK data protection law may give you rights to:

  • access personal information we hold about you;
  • correct inaccurate information;
  • request deletion;
  • restrict certain processing;
  • object to certain processing;
  • receive certain information in a portable format; and
  • withdraw consent where processing is based on consent.

These rights are not absolute and may be subject to legal exceptions.

You also have the right to complain to the Information Commissioner’s Office (ICO).

13. Security

We use reasonable technical and organisational measures intended to protect personal information against unauthorised access, loss, misuse or disclosure.

No internet service can guarantee absolute security.

14. Changes to this policy

We may update this Privacy Policy where our services, technology or legal obligations change.

The current version will be published on ASACC with its latest revision date.
